Copyright Policy

MuzApp, Inc. (“MuzApp”, also referred to “we”, “our”, “us”) affirms that it protects and secures intellectual property rigths. In compliance with the Copyright, Designs and Patents Act 1988(CDPA), we respond to all cases of possible copyright violation.

According to the CDPA, we are entitled to delete any content posted on or through the Service, if there are reasonable circumstances to believe that certain intellectual property rights have been violated. We are allowed to do so without giving you a notice. If there are some reasonable beliefs that the User repeatedly violates ones’ copyright rights, we reserve our right to terminate his/her account as it is stated in the actual Terms of Service.

How to report instances of copyright violation:

If you reasonably believe that one or more Users violate your copyright rights, you shall contact us at info@muzapp.com if you want to protect your rights. You also may contact our Designated Agent by email or mail. Moreover, you shall also fill in a Takedowm Form.

Keep in mind that by filling in a Takedown Form, you bring a legal action and initiate a legal proceeding. If you have any doubts that your copyrights have been infringed, you shall contact your solicitor or if you lack one, contact your local Citizens Advice Bureau or Business Advice Centre.

Intellectual property claims are heard in the Chancery Division of the High Court, either by the Patents Court or the Intellectual Property Enterprise Court (“the IPEC”). If your case is heard in the IPEC, you will not be held liable for the other side’s costs in case you lose unlike in other courts.

You should provide the Designated Agent with the following information in case of copyright infringement:

1) Name, phone number, address (email as well) and other information, so that the Agent could contact you.
2) Your work that allegedly has been infringed.
3) A copy of the infringing work (a link to that infringing content). It is better to do in order to have evidence if the infringer tries to delete this content.
4) You shall make a declaration that you affirm under the oath that you are the author of the content allegedly infringed or you are his exclusive licensee. Moreover, you shall declare herein that your copyright on this content has been infringed.
5) Your signature (either physical or electronic).

If there is a case when your copyright has been infringed by a post on the Service or any content posted on or through the Service, you shall provide us with a link to that content. MuzApp will inform the User who has infringed your copyright that we disable his access to the content on the Service.

If you have nothing to do with a subject described in the Takedown Notice which has been filled up against you, it is possible to make a Counter-Notice. It means that you request to secure the access to the content that has been taken down because of the possibility of copyright infringement.

You are not required to describe the reasons for a Counter-Notice. The fact of misidentification may have taken place.

The same rules apply here (as in a Takedown Form) if you lose the case.

You shall contact the User who, as you think, filled up a false Takedown Form against you and send him a copy of your Counter-Notice. If the User insists on the fact that the copyright infringement has taken place, he/she may bring a legal action against you.

You should provide the Designated Agent with the following information in case of copyright infringement:

1) Name, phone number, address (email as well) and other information, so that the Agent could contact you.
2) Links to the content taken down from the Service.
3) You shall make a declaration that you affirm under the oath that you have nothing to do with the subject described in the Takedown Notice filled up against you. Moreover, you shall declare that the fact of misidentification has taken place and express your consent to the jurisdiction of the Court that shall hear the case brought against you.
4) Your signature (either physical or electronic).

We declare that the person who has filled up the Takedown Notice will be provided with a copy of your Counter-Notice. We restore access to the content until the other party gives us a notice within 10 (ten) business days that he/she has received a copy of your Counter-Notice that he/she initiated a legal process.

MuzApp declares that it restores access to the content in dispute for you within 14 (fourteen) business days in case of not receiving a notice from the other party admitting that the legal process has been initiated.

You may start a copyright dispute only if you have reasonable beliefs that one or more Users infringe your copyrights. In any other cases when some other rights are violated by one or more MuzApp Users (e.g. he/she spreads defamatory, racist or other information about you) you shall contact us at legal@muzapp.com.
